Data controller
Under the Turkish Personal Data Protection Law No. 6698 (“KVKK”), your personal data is processed by BEF Agency (“BEF Agency” or “we”) as the data controller, within the scope described in this notice.
This notice is for visitors of the befagency.com website, people who fill in our contact and newsletter forms, clients and prospective clients who get in touch with us, our clients’ employees, BEF Model applicants and people who appear in our productions.
Personal data we process
- Identity: first and last name; age or date of birth for BEF Model applications.
- Contact: email address, phone number, address, company name and job title.
- Client transactions: requests, quotes, contracts and correspondence; information about the business we serve.
- Finance: invoicing and payment details (such as tax number and IBAN).
- Marketing: newsletter subscription, communication preferences and campaign interactions.
- Transaction security: IP address, browser and device information, visit dates and times, log records.
- Visual and audio records: photos, videos and audio recorded in our productions or shared in BEF Model applications.
We do not intend to process special categories of personal data; please do not share such data in forms or messages.
Purposes of processing
- Replying to your questions, requests and quote enquiries, and scheduling meetings
- Providing social media management, digital advertising, web development, photo and video production and BEF Model services, and managing contracts
- Planning shoots, casting models and talent, and delivering the content we produce to our clients
- Running invoicing, accounting and finance processes
- Sending newsletters, campaign and promotional messages, if you have opted in
- Keeping the website secure, detecting technical issues and improving its performance
- Meeting our legal obligations, responding to competent authorities and protecting our rights in possible disputes
Legal grounds
Your personal data is processed on the following legal grounds set out in Article 5 of the KVKK:
- It is expressly provided for by law (Art. 5/2-a)
- It is directly related to entering into or performing a contract (Art. 5/2-c)
- It is necessary for us to comply with a legal obligation (Art. 5/2-ç)
- It is necessary to establish, exercise or protect a right (Art. 5/2-e)
- It is necessary for our legitimate interests, provided it does not harm your fundamental rights and freedoms (Art. 5/2-f)
- Where none of these apply, your explicit consent (Art. 5/1): for example non-essential cookies, using your images in our portfolio and social media posts, and transfers abroad that rely on consent
Commercial electronic messages are only sent with your approval, as required by Law No. 6563 on the Regulation of Electronic Commerce.
How we collect data
We collect personal data through the contact and newsletter forms on befagency.com, email, phone and WhatsApp messages, our social media accounts, meetings, contracts, BEF Model applications, shoots, and cookies and similar technologies; by automated or partly automated means, electronically and on paper.
Transfers of personal data
Limited to the purposes above and in line with Articles 8 and 9 of the KVKK, your personal data may be shared with:
- Our hosting, email, cloud storage, software and communication service providers
- The clients we work for (for example, delivering footage you appear in to the brand concerned)
- Advertising and social media platforms (such as Meta, Google, TikTok and LinkedIn), to the extent needed to run campaigns
- Our accounting, legal and consulting partners
- Public authorities and courts legally entitled to request it
Some of our service providers may store data on servers abroad. Such transfers are made with the appropriate safeguards set out in Article 9 of the KVKK (for example standard contracts) or, where that is not possible, based on your explicit consent.
Retention
We keep personal data for as long as the purpose of processing requires and for the retention and limitation periods set by law (for example, 10 years for commercial books and records). After that, the data is deleted, destroyed or anonymised. You can unsubscribe from our newsletter at any time.
Your rights under the KVKK
Under Article 11 of the KVKK, you have the right to:
- Learn whether your personal data is processed,
- Request information about the processing,
- Learn the purpose of the processing and whether the data is used accordingly,
- Know the third parties in Türkiye or abroad to whom your data is transferred,
- Request the correction of incomplete or inaccurate data,
- Request deletion or destruction of your data under the conditions of Article 7 of the KVKK,
- Request that corrections, deletions and destructions are notified to the third parties the data was transferred to,
- Object to a result against you arising exclusively from automated analysis,
- Claim compensation for damages arising from unlawful processing.
How to apply
In line with the Communiqué on the Procedures and Principles of Application to the Data Controller, you can send your request in writing to our address below together with information that identifies you, or email it to info@befagency.com from an email address you have previously given us.
We will respond as soon as possible and within 30 days at the latest, free of charge. If the request involves an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.
